Terms of Service

1. About these terms

These Terms of Service ("Terms") govern your use of ColossAuto, a mobile application operated by Valerii Raikovskyi, a private individual residing in Vilnius, Lithuania ("we", "us", "ColossAuto"). By creating an account or using the app, you agree to these Terms.

2. What ColossAuto is

ColossAuto is a marketplace platform that helps drivers in Lithuania discover auto services (mechanics, tire shops, detailing, roadside assistance, etc.) and lets service owners publish listings to be found.

ColossAuto is not a party to any transaction between drivers and service owners. We do not process payments, perform repairs, or warrant the quality of any service listed. All agreements and payments are made directly between users outside the app.

3. Eligibility

You must be at least 16 years old to use ColossAuto. By using the app, you confirm that you meet this requirement. If you create an account on behalf of a business, you confirm that you are authorized to do so.

4. Your account

• Provide accurate information when registering — real email, real name (optional in profile).
• Keep your password secure. You are responsible for all activity under your account.
• One person — one account. Do not create duplicate accounts to circumvent moderation.
• If you suspect unauthorized access, change your password immediately and email collosadmin@gmail.com.

5. Acceptable use

You agree not to:

• Post fake, misleading, or fraudulent service listings.
• Impersonate another person or business.
• Submit reviews that are fake, paid for, written about businesses you have not actually used, or that violate the law (defamation, harassment).
• Send chat messages that are abusive, threatening, harassing, hateful, sexual, or otherwise inappropriate.
• Upload photos that are illegal, copyrighted (without rights), obscene, or unrelated to the service.
• Attempt to gain unauthorized access to other users' accounts or our backend.
• Use ColossAuto to send unsolicited commercial messages (spam).
• Use ColossAuto in violation of Lithuanian or EU law.

We have zero tolerance for objectionable content, abusive behavior, or harassment. We may remove content, suspend, or permanently ban accounts that violate these rules, with no obligation to provide compensation.

6. Reporting and moderation

If you encounter content or behavior that violates these Terms, you can report it through the app or by emailing collosadmin@gmail.com. We review reports promptly and take appropriate action — including content removal, temporary suspension, or permanent account ban.

Service listings are subject to pre-publication moderation — owners submit a listing, and a moderator reviews it before it becomes publicly visible on the map.

7. Content ownership and license

You retain ownership of everything you post on ColossAuto — service listings, photos, reviews, chat messages. By posting, you grant ColossAuto a non-exclusive, royalty-free, worldwide license to host, display, and distribute your content within the app for as long as your content remains on the platform.

If you delete content or your account, this license ends (subject to retention periods explained in the Privacy Policy).

8. Service owners — additional rules

• Only list services you actually operate or are authorized to represent.
• Keep your contact info, hours, and pricing accurate. Outdated info that misleads customers may result in listing removal.
• You are solely responsible for the quality of services you provide to customers contacted through ColossAuto.
• Disputes between you and your customers are between you — ColossAuto is not a mediator or arbitrator.

9. Termination

You can delete your account at any time — through the app (Account → Delete account) or via our web deletion request page.

We can suspend or terminate your access if you violate these Terms, with notice when reasonable. Severe violations (illegal content, fraud, harassment) may result in immediate termination without prior notice.

10. Disclaimer of warranty

ColossAuto is provided "as is" and "as available". We do not guarantee that the app will be uninterrupted, error-free, or that any specific service listed will meet your expectations. We make no warranty about the accuracy of listings, the quality of services performed by third parties, or the conduct of other users.

11. Limitation of liability

To the maximum extent permitted by applicable law, ColossAuto and its operator are not liable for indirect, incidental, consequential, or punitive damages arising out of your use of the app — including loss of profit, data loss, or damages caused by a third-party service contacted through ColossAuto.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under Lithuanian or EU consumer protection law.

12. Changes to these Terms

We may update these Terms occasionally. Material changes will be announced in the app at least 14 days before they take effect. Continued use after the effective date means you accept the new Terms.

13. Governing law and disputes

These Terms are governed by the law of the Republic of Lithuania. Disputes arising out of these Terms or your use of ColossAuto shall be resolved by Lithuanian courts. Consumers retain rights under EU consumer protection law and may also pursue out-of-court resolution through the European Commission's ODR platform.
